1. Acceptance of terms
By accessing and using ODDS · Miami (the "service"), you accept and agree to be bound by the terms and provisions of this agreement. These terms shall be governed by and construed in accordance with the laws of the State of Florida and applicable federal laws.
2. User accounts
When you create an account to join the community, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account. You must be at least 18 years of age to create an account unless otherwise specified. You agree to maintain the security of your password and accept all risks of unauthorized access to your account.
3. Event attendance
RSVP'ing to a run or wellness event constitutes your intent to attend but does not guarantee entry. Events may be subject to capacity limitations, age restrictions, or other requirements as specified in the event details. Event organizers have full discretion over participation requirements, enforced in accordance with local and state regulations. ODDS · Miami is not responsible for any refusal of entry based on failure to meet such requirements.
4. Content
Our service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material related to your fitness journey. You are responsible for the content you post, including its legality, reliability, and appropriateness. You retain all rights to any content you submit. By posting content, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the service.
5. Prohibited uses
You agree not to use the service for any illegal purposes or to conduct any unlawful activity, including but not limited to fraud, embezzlement, money laundering, or any activity that violates local, state, or federal laws. You further agree not to use the service to organize events that promote illegal activities or violate applicable regulations, including those related to public gatherings, fitness activities, noise ordinances, or capacity limitations.
6. Service modifications
We reserve the right to modify or discontinue, temporarily or permanently, the service with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.
7. Limitation of liability
In no event shall ODDS · Miami, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the service. Our liability is limited to the maximum extent permitted by law.
8. Indemnification
You agree to defend, indemnify, and hold harmless ODDS · Miami and its licensors and licensees, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees) resulting from or arising out of your use of the service, participation in community events, or your violation of these terms.
9. Governing law
These terms shall be governed by and construed in accordance with the laws of the United States and the State of Florida, without respect to conflict of laws principles. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. If any provision is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.
10. Changes to terms
We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change is determined at our sole discretion.
11. Compliance with local regulations
Users agree to comply with all applicable local, state, and federal regulations when using the service or attending events. This includes regulations regarding public gatherings, fitness activities, noise ordinances, and capacity limitations as defined by the Florida Statutes, Miami-Dade County Code, and City of Miami municipal codes.
