1. Designated DMCA agent
ODDS · Miami operates as an online service provider under 17 U.S.C. § 512(c) and maintains a designated agent to receive notifications of claimed copyright infringement. 2. How to submit a takedown notice
Email a written notice to dmca@oddsmiami.com (preferred) or send it to the postal address above. To be effective under § 512(c)(3), your notice must include all of the following: (1) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (2) identification of the copyrighted work claimed to have been infringed; (3) identification of the material claimed to be infringing, with information sufficient to locate it (URL, username + timestamp, screenshots); (4) your name, address, phone, and email; (5) a statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the owner. Notices missing any element may not be actionable.
3. What happens after we receive a valid notice
We promptly remove or disable access to the identified material, notify the user who posted it (forwarding a copy of your notice including your contact information so they understand what was removed and can file a counter-notice), and record the notice in the agent's files. We do not adjudicate disputes — those are between you and the user.
4. Counter-notification
If you believe your content was removed by mistake or misidentification, you may file a counter-notice under § 512(g). It must include: (1) your physical or electronic signature; (2) identification of the material removed and its location before removal; (3) a statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification; (4) your name, address, and phone number, a statement that you consent to the jurisdiction of the Federal District Court for your district (or if you are outside the US, the US District Court for the Southern District of Florida), and that you will accept service of process from the original complainant. Send to dmca@oddsmiami.com. After we receive a valid counter-notice we forward it to the original complainant; if they do not file a lawsuit within 10–14 business days we will restore the material.
5. Repeat-infringer policy
In accordance with § 512(i), we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. Three or more valid takedown notices against a user, or a single egregious infringement, generally results in account termination. We may terminate sooner where the conduct is willful or commercial in nature.
6. Misrepresentations
Under § 512(f), any person who knowingly materially misrepresents that material is infringing — or that material was removed by mistake — is liable for damages, including costs and attorney's fees, incurred by the alleged infringer, by us, or by the copyright owner. File responsibly.
7. Trademark and other claims
This procedure is for copyright claims under the DMCA. For trademark, right-of-publicity, defamation, or other reports, email hello@oddsmiami.com with the same level of detail: who you are, what you claim, where the material is, and why you believe it violates your rights.
8. Privacy of submitted notices
We may publish a redacted version of takedown notices (e.g. to a transparency report) and/or forward unredacted copies to organizations like Lumen (lumendatabase.org). If you do not want personal contact information published, file through an agent or legal representative.
